On March 23, 2000, a jury sitting before the Honorable John S. Kennedy of the Court of Common Pleas of York County convicted appellant of kidnapping,*fn1 conspiracy to commit murder*fn2 and murder in the first degree*fn3 in connection with the shooting death of Arthur Irick. At the penalty hearing, the jury found a single aggravating circumstance -- that the murder had been committed during the perpetration of a felony, kidnapping*fn4 -- but no mitigating circumstances;*fn5 accordingly, the jury imposed a sentence of death.*fn6 On May 22, 2000, the trial court formally imposed the death sentence for first-degree murder. Additionally, appellant was sentenced to maximum consecutive sentences of ten to twenty years of imprisonment each for kidnapping and conspiracy.
